Terms and Conditions of Stay

1. Introduction and Acceptance of Terms

1.1. This document sets forth the Terms and Conditions governing the short-term rental service of the Tourist Accommodation Units managed by Casa di Lucy by Preziosa Alessandra, hereinafter referred to as the “Owner.”

1.2. Nature and Business References: Casa di Lucy by Preziosa Alessandra is a Sole Proprietorship, duly registered with the Business Register under a valid VAT number. The company’s activity consists in the professional management of residential properties leased to third parties for exclusively tourist purposes, pursuant to the Italian Civil Code and applicable regional legislation.

Specifically, Casa di Lucy by Preziosa Alessandra offers for rent the properties known as Casa di Spello (CIN Code XXXXXX) and Casa di Foligno (CIN Code YYYYYY). All housing units managed by the company are classified as Tourist Rentals under Regional Law of Umbria No. 8/2017 and subsequent amendments. They are not extra-hotel accommodation facilities (such as Holiday Homes, B&Bs, or Hotels). Therefore, the service provided is limited to the mere provision of accommodation, including final cleaning and initial supply of linen and utilities, excluding hotel-type services such as breakfast, daily housekeeping, or reception.

1.3. By submitting a booking request or completing the payment of a deposit or balance, the Guest acknowledges having read, understood, and fully accepted these Terms and Conditions and the House Rules of the booked property.

2. Booking and Payment Policy

2.1. Booking Request: Availability requests may be submitted via the contact form on the website. The Owner will send a confirmation of availability along with a binding quotation.

2.2. Booking Deposit: To confirm the reservation, a deposit equal to 30% of the total cost of the stay is required. Payment must be made within 2 days from receipt of the quotation.

2.3. Balance Payment: The balance must be paid no later than 30 days prior to the arrival date (Check-in). For last-minute bookings (e.g., within 7 days before arrival), full payment will be required immediately.

2.4. Payment Methods: Payments may be made using the payment methods available on the website. In case of bank transfer, only immediate transfers will be accepted.

2.5. Security Deposit (Damage Guarantee): The Owner reserves the right to request from the Guest, before or upon Check-in, a refundable security deposit against potential damages. This may be managed through:

a) A cash/bank transfer deposit of up to €250, refundable within 7 days after Check-out; or

b) A credit card pre-authorization for the same amount, to be released within 7 days after Check-out, subject to inspection confirming no damage to the property or its contents.

3. Cancellation and Refund Policy

3.1. Cancellation by the Guest: For cancellations received up to 10 days before arrival, all amounts paid, including the deposit, will be refunded in full.

For cancellations received within 10 days before arrival, 70% of the total booking amount will be retained.

In case of No-Show, the entire amount paid will be retained.

3.2. Early Departure: No refund will be granted for early departure or unused portions of the stay.

3.3. Cancellation by the Owner: In rare cases of force majeure or unforeseen events, the Owner reserves the right to cancel the booking. In such cases, all amounts already paid (Deposit and Balance) will be refunded in full, with no further liability or compensation owed.

4. House Rules and Responsibilities

4.1. Internal Rules: The Guest agrees to fully comply with the House Rules displayed in the footer of the website, which are an integral part of these Terms and Conditions. These include, by way of example, check-in/check-out times, no-smoking policy, and maximum occupancy.

4.2. Damages: The Guest is responsible for any damage caused to the property, furniture, or equipment during the stay and agrees to compensate the Owner for the full cost of repair or replacement.

4.3. Limitation of Liability: The Owner shall not be held liable for theft, loss, or damage to the Guest’s personal belongings within the property, nor for any injury or accident involving the Guest and/or their companions during the stay.

4.4. Limitation of Liability for Services: The use of whirlpool tubs, sauna, and all other amenities provided in the houses is at the Guest’s own risk and must follow the instructions set out in the House Rules. The property declines all responsibility for improper use and reserves the right to charge for any resulting damage.

6. Legal Obligations and Guest Registration Data

6.1. Guest Registration (Legal Requirement): In compliance with Italian law (D.L. 50/2017 and T.U.L.P.S.), all guests—regardless of age—are subject to mandatory registration. Each guest must complete the online check-in process prior to arrival, providing full personal details and uploading a readable copy of a valid identity document (ID card or passport). The Owner reserves the right to deny access to the property if the required documents are not provided in full.

6.2. Tourist Rental Agreement: For each stay, a Tourist Rental Agreement must be signed between the Owner and the Guest. This contract shall be signed either electronically or in paper form upon arrival or during online check-in.

6.3. Tourist Tax (Municipality of Spello): The stay is subject to the Municipal Tourist Tax established by the Municipality of Spello (PG). The amount, not included in the rental price, will be calculated and requested separately.

6.4. Payment of Tourist Tax: The Tourist Tax may be paid prior to arrival or at Check-in via PayPal, bank transfer, or credit card. Guests are invited to consult the municipal regulation for applicable rates and exemptions:

7. Governing Law and Jurisdiction

7.1. These Terms and Conditions are governed by Italian law.

7.2. For any dispute arising from the interpretation or execution of this agreement, the exclusive jurisdiction shall be that of the Court of Foligno - Perugia.

Purpose of Processing: To send, via email or telephone contact (SMS, WhatsApp), promotional communications, discounts, special offers, and updates on services and availability of Casa di Lucy properties.

Legal Basis: Consent of the data subject (Art. 6(1)(a) GDPR).

Nature of Data Provision: Optional. Refusal to provide consent does not affect access to other services (e.g., responses to contact or booking requests).

3. Browsing Data (Technical Cookies)

Type of Data: Data related to the website’s technical operation (e.g., session management, language preferences).

Purpose of Processing: To ensure the correct technical functioning and accessibility of the website.

Legal Basis: Legitimate interest of the Controller.

Methods and Duration of Data Processing

Processing Methods: Data are processed using electronic and paper-based tools, with appropriate security measures to prevent loss, unlawful use, or unauthorized access.

Data Retention Period:

Data provided through the contact form (Section 1) are retained for the time strictly necessary to respond to the request and subsequently for a maximum period of 12 months for administrative purposes or to manage potential disputes. If the request results in a booking, the data will be retained for the duration of the contractual relationship and for the subsequent period required by law (for tax, administrative, or accounting purposes).

Data processed for marketing purposes (Section 2) are retained until the withdrawal of consent by the user or for a maximum period of 24 months from the last contact or interaction.

Data Communication and Disclosure

Your data will not be disclosed (i.e., made available to an indefinite number of people).
